Welcome to PropertyPilot Software, LLC (“Company”, “we”, “our”, or “us”). These Terms of Use (“Terms”) govern your access to and use of our platform, website, mobile applications, and related services (the “Services”), including tools for tracking user location and managing property and government-related data.
By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
1. Eligibility
You must be at least 18 years old to use the Services. If you are using the Services on behalf of an organization, you represent and warrant that you are authorized to bind that organization.
2. Use of Services
You agree to use the Services only for lawful purposes and in accordance with these Terms. You must not:
- Access or use data in violation of any applicable law or regulation.
- Reverse engineer, decompile, or copy any part of the Services.
- Interfere with or disrupt the security, integrity, or performance of the Services.
3. User Location Tracking
By using our mobile applications or location-enabled features:
- You consent to the collection and use of your geolocation data.
- This data may be used to display nearby properties, validate inspections, or improve location-based features.
- You may disable location tracking at any time in your device settings, though some functionality may be limited.
4. Data Collection & Property Information
Our Services store and process various types of data, including:
- Property data, such as ownership records, zoning, parcel ID, and building information.
- Public and government records, including filings, permits, and ordinances.
- User-generated content, such as notes, tasks, and attachments you upload.
- You acknowledge that while we strive for data accuracy, we do not guarantee the completeness or correctness of any property or government data presented.
5. Account and Security
You are responsible for:
- Maintaining the confidentiality of your account credentials.
- All activities that occur under your account.
- Notifying us immediately of any unauthorized access or breach.
We reserve the right to suspend or terminate accounts that violate these Terms.
6. Intellectual Property
The Services and all content (excluding public records) are owned by Property Pilot, including:
- Software code, user interface designs, and database schema.
- Logos, trademarks, and proprietary algorithms.
You are granted a limited, non-exclusive, non-transferable license to use the Services as intended.
7. Third-Party Services and Data
Our platform may integrate with third-party systems or display third-party data. We are not responsible for the accuracy, reliability, or availability of third-party services or content.
8. Data Retention & Deletion
We retain your data as long as necessary to provide the Services or as required by law. You may request data deletion, subject to any legal or regulatory obligations we must satisfy.
9. Limitation of Liability
To the fullest extent permitted by law:
- We disclaim all warranties, express or implied.
- We are not liable for any indirect, incidental, or consequential damages arising from your use of the Services.
10. Modifications
We may update these Terms from time to time. You will be notified of material changes, and continued use of the Services constitutes acceptance of the updated Terms.
11. Governing Law
These Terms are governed by the laws of the State of New Jersey, without regard to its conflict of laws rules.
